In recent years, Indonesian Tax Authority have increased their scrutiny towards transfer pricing. This has been followed by issuance of Directorate General of Tax (DGT) regulation No. PER-22/PJ/2013 regarding transfer pricing audit guidelines, which comes as improvement to the standard audit procedures. The increase focus of the Directorate General of Tax (DGT) towards Transfer Pricing as also led that Transfer Pricing has become one of the most disputed topic in Indonesian taxation. In anticipation there of, the Government has issued Government regulation No. 74 year 2011, followed by Directorate General of Tax (DGT) regulations PER-48/2010, and PER-69/2010, which in essence contain regulation to avoid and resolved cross border transfer pricing disputes.
When cross border transfer pricing dispute occur, domestic dispute resolution mechanism will often not resolve double taxation issues. To this end, most tax treaties provide alternative dispute resolution mechanism in form of Mutual Agreement Procedures (MAP’s) and Advance Pricing Agreements (APA’s) which could provide a timely. Such procedures, if properly designed and implemented, enable to reduce the uncertainty, expense, and delayed associated with a general resort to litigation or a failure to provide any recourse.
In this seminar, our tax professionals will share practical experience in dealing with such audits and disputes, in particular the topics covered will include the most encountered issues, the corresponding strategy to proceed accordingly and provide participants in depth knowledge about legal framework, situations when taxpayer needs to apply MAP and APA, practical application, both advantages and disadvantages of MAP and APA, and recent trends. In the end, this seminar should help participants to prepare an effective strategy in dealing with transfer pricing audits and disputes.
